Product teams have the same bottleneck. A new feature hits the roadmap. Someone asks, “Does this need a DPIA?” The question goes to legal or the DPO. It sits in a queue. Two weeks later, someone reviews the product spec, asks a dozen follow-up questions, and produces an assessment that could have been started on day one – if the right information had been structured correctly from the start.
The problem is not that DPIAs are hard. The problem is that the intake is unstructured, the criteria are scattered across regulations and guidance documents, and the person reviewing has to context-switch between reading a product spec and cross-referencing GDPR Article 35, EDPB guidelines, and (as of January 2026) the new CCPA/CPRA risk assessment requirements. That is slow, manual, and scales terribly.
This blueprint builds an AI agent that handles the preliminary assessment – the structured first pass that determines whether a full DPIA is needed, identifies the key risk areas, maps the data flows, and drafts initial mitigation recommendations. The human privacy professional still makes the final determination. But instead of starting from a blank page and an unstructured product spec, they start from a structured pre-assessment report with the heavy lifting already done.
Important caveat
This agent produces a preliminary assessment – a structured first pass, not a legally binding DPIA. The final DPIA determination, risk acceptance, and sign-off must come from a qualified privacy professional (your DPO, privacy counsel, or equivalent). In jurisdictions where the DPIA is a legal obligation, the accountability sits with the data controller, not an AI tool.
Which AI Tools Are Safe for Processing Product Specs and Privacy Assessments
Product specifications often contain sensitive business information – unreleased features, data architecture decisions, vendor relationships, internal system names. Before building this workflow, your stack needs to guarantee that this information stays under your control.
The recommendations here are the same as our Regulatory Review Agent Blueprint, but I will summarize the key points because they are especially important for DPIA work where the product spec itself may be confidential.
Privacy-Safe Stack Options
Cloud APIs with contractual data protection:
- Claude API (Anthropic) – API data explicitly not used for training under Commercial Terms. My primary recommendation.
- Azure OpenAI – Data stays in your Azure tenant. Covered by Microsoft DPA. HIPAA, SOC 2, GDPR compliant.
- Amazon Bedrock – Claude or other models deployed within your AWS VPC. Data never leaves your AWS account.
Self-hosted for maximum control:
- Llama 4 Scout via Ollama or vLLM – 10M token context, runs on your infrastructure.
- Qwen 3 235B – Strong reasoning, 29+ languages for multinational teams.
For orchestration:
- n8n (self-hosted) – SOC 2 Type II compliant, all data stays on your servers. Best for privacy-sensitive automation.
- Power Automate – Good alternative if your organization is Microsoft-native. Covered by your existing M365 DPA.
Do not use consumer chatbot interfaces (ChatGPT free/Plus, Gemini consumer) for DPIA work. Your product specs and data flow descriptions are business-confidential. Use the API tier or enterprise tier of whichever provider you choose, and confirm the data processing terms with your legal team.
When Is a DPIA Required Under GDPR Article 35 and CCPA – The Trigger Criteria Your Agent Needs to Know
Before the agent can assess whether a product needs a DPIA, it needs to understand the trigger criteria. This is the regulatory knowledge that powers the entire workflow. I am going to lay out both frameworks because as of January 2026, many organizations operating in the US and EU need to assess against both.
GDPR Article 35 – Mandatory DPIA Triggers
Article 35(3) lists three processing types that always require a DPIA:
- Systematic and extensive evaluation of personal aspects based on automated processing, including profiling, where decisions produce legal effects or similarly significantly affect individuals.
- Large-scale processing of special category data (Article 9 – health, biometric, genetic, racial/ethnic origin, political opinions, religious beliefs, trade union membership, sex life/orientation) or criminal conviction data (Article 10).
- Systematic monitoring of a publicly accessible area on a large scale (CCTV, facial recognition, location tracking in public spaces).
The EDPB Nine Criteria – When Two or More Apply, Do a DPIA
Beyond the three mandatory triggers, the European Data Protection Board published nine criteria. If a processing activity meets two or more of these, a DPIA should be conducted:

CCPA/CPRA Risk Assessment Triggers (Effective January 1, 2026)
As of January 2026, the CCPA now requires formal risk assessments before initiating certain processing activities. The triggers differ from GDPR but overlap significantly:
- Selling or sharing personal information for cross-contextual behavioural advertising
- Processing sensitive personal information
- Using automated decision-making technology (ADMT) for significant decisions concerning consumers
- Using personal information as training data for AI or ADMT systems
- Large-scale profiling of consumers
- Automated processing that extrapolates or infers sensitive information about consumers
Risk assessments must be completed before initiating the processing activity, updated within 45 calendar days of material changes, and reviewed at least every three years. By April 2028, businesses must submit attestations to the CPPA confirming assessments were completed.

RULES:

are extremely common - your job is to make the gaps visible, not

This intake prompt is the foundation of the entire workflow. I have iterated on it across dozens of product specs and the single most valuable design decision is the information_gaps array. Most product specs are not written with privacy in mind, and the gaps are often more important than the information that is present. Flagging them explicitly gives the DPO a clear list of follow-up questions to send back to the product team before the full DPIA begins.
Step 2: GDPR Article 35 and CCPA Trigger Screening – Does This Product Need a Full DPIA?
This is the core screening step. The agent takes the structured product profile from Stage 1 and evaluates it against both the GDPR and CCPA trigger criteria. The output is a clear determination: full DPIA required, recommended, or not required at this time.

RULES:
